These Terms of Service ("Terms") govern your use of https://sitefeasibility.inkwell.tech and the Site Feasibility demonstration made available through it (together, the "Site"). The Site is operated by Inkwell Technology Studios, Inc. ("Inkwell"). By accessing or using the Site, you agree to these Terms. If you don't agree, don't use the Site.
1. Eligibility
You must be at least 18 years old and able to form a binding contract to use the Site. If you use the Site on behalf of a company or other organization, you represent that you have authority to bind that organization to these Terms, and "you" includes that organization.
2. Demonstration access
Access to the demonstration requires you to provide a valid email address. You agree to provide accurate information and not to share your access with others. Inkwell may grant, limit, suspend, or revoke demonstration access at any time, for any reason, without notice. The demonstration is provided for evaluation purposes only and may be changed or discontinued at any time.
3. No professional advice; no reliance on outputs
The demonstration may display site feasibility analyses, scenarios, rankings, and related information based on zoning, environmental, utility, and other data ("Outputs"). Outputs are illustrative and for demonstration purposes only. They may be incomplete, out of date, or inaccurate, and may rely on sample or third-party data.
Outputs are not legal, engineering, planning, environmental, financial, or other professional advice. You should not rely on Outputs to make any acquisition, development, investment, permitting, or other decision. Always consult qualified professionals and the applicable governing authorities.
Outputs may be generated in part by automated systems, including machine learning, and may be inaccurate or incomplete. You are responsible for evaluating and verifying any Output before using it.
4. Acceptable use
You agree not to:
- Copy, scrape, crawl, or systematically extract content, data, or Outputs from the Site
- Reverse engineer, decompile, or attempt to derive the source code, models, algorithms, or underlying data of the Site
- Use the Site or Outputs to build or train a competing product or service, including any machine learning model
- Interfere with, disrupt, or attempt to gain unauthorized access to the Site or its systems
- Probe, scan, or test the vulnerability of the Site without Inkwell's written permission
- Use the Site in violation of any law or third-party right
- Misrepresent your identity or affiliation
5. Confidentiality of the demonstration
The demonstration, including its features, interface, performance, and Outputs, is Inkwell's confidential information. You agree not to disclose, publish, or share screenshots, recordings, or descriptions of the demonstration with third parties without Inkwell's prior written consent, except within your own organization for the purpose of evaluating a potential business relationship with Inkwell.
6. Intellectual property
The Site and everything on it, including software, text, graphics, logos, data, and Outputs, are owned by Inkwell or its licensors and are protected by intellectual property laws. Subject to these Terms, Inkwell grants you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for your internal evaluation purposes. All rights not expressly granted are reserved. Inkwell's names and logos are its trademarks and may not be used without its permission.
7. Feedback
If you send Inkwell comments, suggestions, or ideas about the Site ("Feedback"), you grant Inkwell a perpetual, irrevocable, worldwide, royalty-free right to use that Feedback for any purpose without obligation to you.
8. Third-party services and links
The Site may link to or rely on third-party websites, data, or services. Inkwell doesn't control them and isn't responsible for their content, accuracy, or practices. Your use of third-party services is at your own risk and subject to their terms.
9. Privacy
Inkwell's collection and use of personal information is described in its Privacy Policy, which is part of these Terms.
10. Disclaimer of warranties
THE SITE, THE DEMONSTRATION, AND ALL OUTPUTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND AVAILABILITY. INKWELL DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
Some jurisdictions do not allow the exclusion of implied warranties or the limitation of certain damages. If those laws apply to you, some of the above disclaimers and limitations may not apply, and you may have additional rights.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, INKWELL AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATING TO THE SITE OR OUTPUTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. INKWELL'S TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (US$100) OR THE AMOUNT YOU PAID INKWELL IN THE SIX (6) MONTHS BEFORE THE CLAIM AROSE. THESE LIMITATIONS APPLY EVEN IF ANY REMEDY FAILS OF ITS ESSENTIAL PURPOSE.
12. Indemnification
You agree to indemnify and hold harmless Inkwell and its affiliates, officers, employees, and licensors from any claims, losses, and expenses (including reasonable attorneys' fees) arising from your misuse of the Site, your violation of these Terms, or your reliance on Outputs. Inkwell may control the defense of any matter subject to indemnification, and you agree to cooperate with Inkwell.
13. Termination
Inkwell may suspend or terminate your access to the Site at any time. Sections 3, 5, 6, 7, 10 through 12, and 14 through 18 survive termination.
14. Governing law and venue
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or the Site will be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to their jurisdiction.
15. Export controls
You agree not to export or re-export the Site, the demonstration, or Outputs in violation of U.S. export laws, including to any U.S.-embargoed country or to anyone on a U.S. Government list of prohibited or restricted parties. You represent that you are not located in any such country or on any such list.
16. Injunctive relief
You agree that a breach of Sections 4 or 5 would cause Inkwell irreparable harm for which money damages would not be an adequate remedy, and that Inkwell is entitled to injunctive or other equitable relief, in addition to any other remedies, without posting a bond.
17. California residents
Under California Civil Code Section 1789.3, California users may report complaints to the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs, in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.
18. Changes and general terms
Inkwell may update these Terms from time to time by posting a revised version on the Site with a new effective date. If Inkwell makes material changes, it will make reasonable efforts to notify you, such as by email. Continued use after an update means you accept the revised Terms. If any provision is found unenforceable, the rest remains in effect. Inkwell's failure to enforce a provision is not a waiver. You may not assign these Terms without Inkwell's consent; Inkwell may assign them freely. These Terms are the entire agreement between you and Inkwell regarding the Site, unless you and Inkwell have signed a separate written agreement covering the same subject, in which case that agreement controls.

Privacy Policy
Effective date: October 12, 2026
This Privacy Policy explains how Inkwell Technology Studios, Inc. ("Inkwell") collects, uses, and shares personal information through https://sitefeasibility.inkwell.tech and the Site Feasibility demonstration (together, the "Site").
1. Information Inkwell collects
Information you give Inkwell. To access the demonstration, you provide your email address and may answer a few questions about your project, such as county, asset type, and short qualifying questions. Inkwell also records how you arrived at the Site (such as campaign or UTM parameters) and a record of your agreement to the Terms (timestamp, IP address, and policy version). If you contact Inkwell, Inkwell collects whatever you choose to include, such as your name, company, title, and message.
Information collected automatically. When you visit the Site, Inkwell and its service providers automatically collect certain technical information, including IP address, browser and device type, operating system, referring pages, pages viewed, actions taken in the demonstration, and dates and times of access. This information is collected using cookies, log files, and similar technologies.
Information Inkwell doesn't want. Please don't submit sensitive personal information (such as government ID numbers, financial account numbers, or health information) through the Site.
2. How Inkwell uses information
Inkwell uses personal information to:
- Provide, secure, and manage access to the demonstration
- Add your contact information to Inkwell's business contact database and follow up with you about Site Feasibility, other Inkwell products and services, and a potential business relationship
- Respond to your questions and requests
- Understand how the Site and demonstration are used so Inkwell can improve them
- Detect, prevent, and address fraud, abuse, and security issues
- Comply with legal obligations and enforce Inkwell's Terms of Service
De-identified information. Inkwell may de-identify or aggregate information so it can no longer reasonably be linked to you, and use it for any lawful purpose. Inkwell will not attempt to re-identify it.
3. How Inkwell shares information
Inkwell does not sell your personal information and does not share it for cross-context behavioral advertising. Inkwell shares personal information only:
- With service providers that host the Site, provide analytics, send email, or otherwise help Inkwell operate, under contracts that limit their use of the information to providing services to Inkwell. These include Notion, which holds contact records, and Google Analytics and Mixpanel, which receive usage data tied to pseudonymous identifiers that Inkwell does not intentionally associate with your contact information, as described in Section 4.
- For legal reasons, if Inkwell believes disclosure is required by law or needed to protect the rights, property, or safety of Inkwell, its users, or others.
- In a business transaction, such as a merger, acquisition, financing, or sale of assets, in which case information may transfer to the successor entity.
- With your consent or at your direction.
4. Cookies and analytics
Inkwell uses a small number of cookies and similar technologies:
- Essential cookies keep you signed in to the demonstration and remember your cookie choice. The consent cookie stores your accept or reject choice, a random consent ID, a timestamp, and the policy version. It is first-party and is not shared with any third party.
- Analytics cookies measure how the Site is used, through Google Analytics and Inkwell's own usage analytics (Mixpanel). They rely on random identifiers and do not include your email address or name. Analytics cookies are set only after you accept them in the cookie banner.
You can change your choice at any time through the cookie settings link in the Site footer, or control cookies through your browser settings; blocking essential cookies may prevent the demonstration from working. If your browser sends a Do Not Track or Global Privacy Control (GPC) signal, Inkwell does not run analytics for that browser, and treats GPC as a valid request to opt out of the sale or sharing of personal information.
5. Email communications
Inkwell may email you about your demonstration access, Site Feasibility, and other Inkwell products, services, and news. You can opt out of non-essential emails at any time using the unsubscribe link in the email or by contacting legal@inkwell.tech. Inkwell may still send you messages required to administer your access.
6. Data retention
Inkwell keeps personal information only as long as needed for the purposes in this policy, including to maintain demonstration access and Inkwell's business contact records, unless a longer period is required by law. When it is no longer needed, Inkwell deletes or de-identifies it. If you make a verified deletion request, Inkwell deletes the personal information it can reasonably identify and associate with your request from active systems within 30 days, subject to limited retention in backups and applicable legal requirements and exceptions. Inkwell keeps a record of each request and how it was resolved.
7. Security
Inkwell uses reasonable administrative, technical, and physical safeguards to protect personal information. No method of transmission or storage is completely secure, and Inkwell cannot guarantee absolute security. If a data breach affects your personal information, Inkwell will notify you and regulators as required by law.
8. Your rights and choices
Depending on where you live, you may have the right to:
- Know what personal information Inkwell has collected about you and how Inkwell uses and shares it
- Access or receive a copy of your personal information
- Correct inaccurate personal information
- Delete your personal information
- Opt out of sale or sharing (Inkwell doesn't sell or share as defined by law)
- Object to or restrict certain processing, and withdraw consent where processing is based on consent
California residents. Under the California Consumer Privacy Act (CCPA), as amended, in the past 12 months Inkwell collected identifiers (such as email and IP address), commercial information (such as business inquiries), and internet or network activity information, from the sources and for the purposes described above. Inkwell disclosed these categories to service providers for business purposes. Inkwell does not sell or share personal information or use sensitive personal information to infer characteristics. Inkwell will not discriminate against you for exercising your rights. California's "Shine the Light" law (Cal. Civ. Code Section 1798.83) also lets California residents request information about disclosures of personal information to third parties for their direct-marketing purposes; Inkwell does not make such disclosures.
Other U.S. states. Residents of states with comprehensive privacy laws, including Tennessee, Virginia, Colorado, Connecticut, and Texas, have similar rights to access, correct, delete, and obtain a portable copy of their personal information, and to opt out of its sale or use for targeted advertising.
Visitors from the EEA, UK, and Switzerland. Inkwell processes personal information based on its legitimate interests in operating the Site and evaluating business relationships, your consent where required, and to comply with legal obligations. You may lodge a complaint with your local data protection authority. Your information may be transferred to and processed in the United States, where Inkwell uses appropriate safeguards as required by law.
To exercise any of these rights, email legal@inkwell.tech. Inkwell will verify your request using the information you've provided. You may use an authorized agent to make a request on your behalf, subject to verification. If Inkwell denies your request, you may appeal by emailing legal@inkwell.tech. If you have concerns about the outcome of an appeal, you may contact your state Attorney General.
Limitations for analytics data. Inkwell provides access to, and deletes, personal information it can reasonably identify and associate with a verified request, such as your contact record. Site analytics in Google Analytics and Mixpanel use pseudonymous identifiers stored in your browser, which Inkwell does not intentionally associate with your contact information, so Inkwell may not be able to locate analytics data from your email address alone. If you provide the analytics identifier for your browser, available in the Site's cookie settings, Inkwell will delete the associated analytics data where those records can be identified. Because access requests involve disclosing data, Inkwell may require additional verification for them or limit them to information it can reliably associate with you.
9. Children
The Site is intended for business users and is not directed to children under 16. Inkwell does not knowingly collect personal information from children. If you believe a child has provided Inkwell information, contact Inkwell and it will be deleted.
10. Changes to this policy
Inkwell may update this Privacy Policy from time to time. Inkwell will post the revised version on the Site with a new effective date, and where changes are material, will make reasonable efforts to notify you, such as by email to the address you provided.
